Non-Discrimination Policy

Equal Employment Opportunity

SimonMed Imaging believes that all individuals are entitled to equal employment opportunity. This means that SMI does not discriminate against its employees or applicants because of sex (which includes pregnancy, childbirth, breastfeeding and medical conditions related to pregnancy, childbirth or breastfeeding), gender, gender identity, gender expression, race, color, religious creed, religion (including religious dress and grooming practices), national origin (including language use restrictions and possession of a driver’s license issued under Vehicle Code section 12801.9), ancestry, citizenship, age, marital status, medical condition, physical disability, mental disability, genetic information, sexual orientation, or any other characteristic protected by state or federal law. Equal employment opportunity also includes freedom from any form of unlawful harassment, and will be extended to all persons in all aspects of the employment relationship, including recruitment, hiring, pay, training, promotion, transfer, discipline, layoff and termination.

SimonMed Imaging has a “Zero Tolerance” policy toward workplace violence and toward unlawful harassment and discrimination of any kind, including sexual harassment. As a SMI employee, you must respect the rights of others to be free from unlawful discrimination, harassment, and violence in the workplace. Pay discrimination between employees of the opposite sex performing substantially similar work, as defined by the California Fair Pay Act and federal law, is prohibited. Pay differentials may be valid in certain situations defined by law. Employees will not be retaliated against for inquiring about or discussing wages. However, SMI is not obligated to disclose the wages of other employees.

Equal employment opportunity will be extended to qualified disabled persons in all aspects of the SMI-employee relationship, including recruitment, hiring, training, promotion, transfer, discipline, layoff, recall and termination.

SimonMed Imaging further affirms that it will provide reasonable accommodation to the known physical or mental limitations of an otherwise qualified disabled employee or applicant. SimonMed Imaging will also engage in a good-faith and timely interactive process to determine whether and to what degree reasonable accommodation is appropriate.

Ada Notice

SMI’s policy, in accordance with federal and state law, is that no program or activity administered by SMI shall exclude from participation, deny benefits to or subject to discrimination any individual solely by reason of his or her disability. SMI will take appropriate steps to ensure that every person with a disability is granted equal use of its services and facilities. SMI is committed to making reasonable access to MRI and other radiological services and equipment with compatible assistive devices to facilitate disabled patients’ use of its services and equipment.

When scheduling patient appointments, SMI’s staff will ask if the patient will need any special assistance, modification of policy, or auxiliary aid or service at the examination because of a disability. SMI shall provide the reasonable requested assistance or auxiliary aids or services at the patient’s scheduled exam to enable the patient to access SMI’s radiological services and equipment. Whenever a disabled patient or prospective patient cannot be reasonably accommodated at the SMI facility of their first choice, SMI will engage in an interactive process with the patient in an attempt to accommodate them at a reasonably close accessible SMI location within its service area. If the individual with a disability did not identify a need for a particular reasonable accommodation when asked by the staff person who scheduled the appointment, SMI shall accommodate the individual unless doing so would fundamentally alter the nature of its services.
